These Terms of Service (“Terms”) govern your use of StayHard’s mobile application, website at stayhard.app, and related services (together, the “Services”). By creating an account or using the Services, you agree to these Terms.

1. The Services
StayHard offers private accountability tools for small groups of friends: daily check-ins with photos, commitments (“pacts”), invites, and lightweight social features. Features may change over time.
2. Eligibility
You must meet the minimum age in your jurisdiction to enter a contract and use the Services. If you use an anonymous (guest) session, these Terms still apply to the extent relevant.
3. Accounts
You are responsible for your login credentials and for activity under your account. Notify support@stayhard.app if you suspect unauthorized access.
4. Acceptable use
You agree not to:
- Harass, threaten, abuse, discriminate against, or endanger others.
- Upload illegal content, non-consensual intimate imagery, or content depicting minors in a sexual or violent context.
- Attempt to reverse engineer, scrape, overload, or bypass access controls except as allowed by law.
- Misrepresent your identity in a way that is likely to harm others or violate applicable law.
5. Your content
You retain rights to content you submit. You grant StayHard and its service providers a worldwide, non-exclusive license to host, store, reproduce, display, and process your content solely to operate and improve the Services, including showing check-ins to friends you connect with according to product rules and privacy settings.
6. Privacy
Our Privacy Policy explains how we handle personal data. It is incorporated into these Terms by reference.
7. Third parties
The Services rely on third-party infrastructure (for example Supabase for backend and storage, and Vercel for the website). Their terms are linked in our Privacy Policy.
8. Disclaimers
The Services are provided “as is” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
9. Limitation of liability
To the fullest extent permitted by law, StayHard and its suppliers will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, arising from your use of the Services. Aggregate liability for any claim relating to the Services shall not exceed the greater of (a) USD $50 or (b) the amounts you paid us for the Services in the twelve months before the claim.
10. Suspension & termination
We may suspend or terminate access for violations of these Terms or to protect users. You may stop using the Services at any time and may delete your account via the app (see the Privacy Policy).
11. Governing law
These Terms are governed by the laws of [Your jurisdiction], excluding conflict-of-law rules. Courts in [Your venue] have exclusive jurisdiction, except where consumer protection laws require otherwise.
